On Thursday, a meeting of the Union Cabinet chaired by Hon’ble Prime Minister Shri Narendra Modi approved the order of giving reservation to economically weaker sections of the society and promotion in government jobs to Schedule Caste and Schedule tribes in the state of Jammu & Kashmir.

The Constitution( seventy- seventh amendment) Act, 1995 was enacted after inserting clause (4A) under Article 16, providing the benefit of promotion to the weaker sections of the society such as Schedule Castes and Scheduled Tribes. On the other hand, the Constitution (one hundred and third amendment act), 2019 provides 10% reservation to economically weaker sections of the society. It has been applied in the country except in the state of Jammu & Kashmir and with its extension, the economically weaker sections of the state can also avail its benefits. “It will serve the purpose of application of relevant provisions of the Constitution of India, as amended through the Constitution (Seventy-Seventh Amendment) Act, 1995 and Constitution (One Hundred and Third Amendment) Act, 2019 for Jammu and Kashmir, by issuing the Constitution (Application to Jammu and Kashmir) Amendment Order, 2019 by the President under clause (1) of Article 370,” it said.

It was also decided by the Union Cabinet to declare an ordinance- The Jammu and Kashmir Reservation (Amendment) Ordinance, 2019 providing benefits of reservation to those living in the areas adjoining International Border in the state. Finance Minister Mr. Arun Jaitley stated, “It provides for amendments in the Jammu and Kashmir Reservation Act, 2004 to bring persons residing in the areas adjoining International Border within the ambit of reservation at par with persons living in areas adjoining Actual Line of Control,”.

The similar facility was till now available only to the people living in the areas near Actual Line of Control. The proposal moved by the Jammu and Kashmir government is under President’s rule.
