Parliament passed Constitution (124th amendment) bill on 9th January 2019. It was passed by Rajya Sabha on the same day itself with 165 MPs votes for the bill and 7 against it however the earlier bill was tabled by Minister of Social Justice Thawar Chand Gehlot in the Lok Sabha. Where it was passed on 8th January 2019 after four and a half hour long debate, 323 Lok Sabha members voted to support the bill and only 3 voted against it. The bill will be sent to the president for assent. All parties are supporting the proposed law despite opposition calling it a pre-poll ‘stunt’ of the Modi government. Prime Minister Modi and Congress president Rahul Gandhi were present there during the voting. Law minister Ravi Shanker Prasad said the reservation would be applicable to all the jobs in the state and central government.

Modi later thanked all the MPs for supporting the bill and called it a ‘Landmark moment’ which will ensure dignity and availability of all the possible opportunities for a poor person irrespective of cast and creed.

The bill focuses on 10 percent reservation for the economically weaker section as they remained excluded from admitting in higher educational institutions and government employment.

Reference is made to article 46 of the constitution of India, a Directive Principle of State Policy which urges the government to protect interest of an economically weaker section of the society.

The constitution of India has been amended to fulfill mandates of article 46 and to ensure that economically weaker section get admission in institutions for higher education and get employed in government institutions.

Under the bill article 15 of the Indian Constitution sought to be amended. It will provide ten percent reservation to economically weaker sections to get admission in educational institutions, whether aided or unaided by the state, other than the minority educational institutions referred to in clause (1) of the article 30.

Minister of Social Justice Thawar Chand Gehlot Said that this is a historic day, and Prime Minister Narendra Modi has taken historic decision across tenure. Further, he said “Lakhs and crores of poor from general category and every religion will get benefited by the law.
